Today, I received an email from SEDO for a domain I agreed to sell through their brokerage service and after releasing the auth code, was requested by the transfer specialist at SEDO to issue an invoice to the buyer. Has anyone come across this situation? I did not charge HST on the sale price and here is what they wrote to me:

"The buyer has submitted payment to our account and has requested an invoice or receipt.
Please create an invoice or receipt with the full amount xxxx USD and upload it in the "Transfer Documents" section or send it by fax to 617-499-7219.
Kindly note that all sales prices negotiated through the Sedo marketplace are considered to be end prices for the buyer including the VAT valid for the Seller.
Please issue an invoice/receipt with the following details.
XXXXXX XXXXXX
XX, XXXXX XX
Waterloo, ON
Canada
If you pay for the Sedo commission, you will receive an invoice from us once the transaction has been completed. "

Anyone here issued an invoice to SEDO?

If you sell outside of Canada you don't have to worry about sales tax

I am just in the process of looking at other services that sell for me, like SAW which technically is in Europe and the transaction is all done overseas.

I'm not sure but I don't think Sales Tax is an issue unless the Service also does business in Canada like GoDaddy does.

That is why I buy some domains through a partner service because anything bought directly at GoDaddy is subject to a sales tax.

I also don't think the Tax applies to a Sedo sale.

Like I said, it merits some research to be sure because the last thing you want is to owe a bunch of back taxes.

PS. The commission is also an expense in in all circumstances would be tax deductible if you are charging taxes.

Thank you Frank. That was my concern too. Had I known that I was selling the domain to another Canadian, I would have included the sales tax on top of the amount. But I am forced to pay the tax portion from the proceeds and hence my question. I don't think they could force me to issue an invoice after the fact. I told them t issue an invoice to the buyer like Escrow does and that should be enough for the buyer for his/her records.

you can't apply tax until you know their billing address, so you can never negotiate a final price without knowing that info.

I'm making a big deal out of this with godaddy's brokers more and more.

But I believe that if the buyer tries to avoid paying taxes, they're the ones liable for paying the taxes. In theory, even if you are a small domain seller not required to collect GST, the buyer is still obligated to remit the GST themselves directly. They're obligated to pay the tax, regardless if you're required to collect it. So I think a hidden buyer under escrow would fall under that situation, it's their responsibility. This was something I read relatively recently. But it would be good to get that in writing from CRA.

But being told by CRA I owe them uncollected GST has always been a concern of mine, but have never had it actually be an issue.

Thanks @rlm for that clarification. I report my income from the brokerage house deals as income in USD. I do add the HST part for the CDN sales obviously.
