I'm seeing more and more UDRP's coming through with a reverse hijacking outcome.

They system is badly stacked toward the domain owner because usually it is a big company with a legal team that files the false dispute leaving the domain owner to defend himself in some cases at great expense.

I think a lot of this could be solved if there was a $5000 refundable UDRP application fee. Should the judgement go to reverse hijacking then the fee would be released to the domain owner to cover time and expenses.

I know the domain owner can sue back but that is again an expense and involves even more time stolen from the domain owner.

What is your opinion, should there be a refundable deposit fee on a UDRP?

Once they have all the facts and know that they don't have a chance at winning the case, they should withdraw the case—but they don't. It’s pretty shady to proceed with the case, banking on the owner not responding so they can try to steal the domain. Above 2 cases could've been withdrawn but NOPE


Yes i agree there should be a penalty.
