DeleteFacebook.com: Possibly an example of fair use (1 Viewing)

Facebook is a globally known brand, as witnessed by 3 billion accounts worldwide. The company founded by Mark Zuckerberg in his university dorm is worth billions of dollars.

It’s also a controversial social media platform, currently under pressure to change how it handles news, misinformation, and other elements of its addictive qualities. On Monday, Facebook faced a multi-hour downtime due to DNS changes. Its stock dropped on the same day, but climbed up on Tuesday.

I wonder what would happen if the .ca version went to CDRP

Interesting. How long has the .ca been active? Is it yours? lol

Either way, I don't think they would win if they filed a CDRP... due to fair use (unless the respondent didn't bother filing a response, then maybe he/she would lose).

It's like all the [company]sucks.com cases, where complainant can't meet all three parts of the CDRP test/criteria (to be successful in their claim).

1) It may be seen as bad faith with the purpose of disrupting someone’s business; but 2) they arguably have a legitimate interest; and 3) it's not confusingly similar. They might be able to successfully argue a few parts of the test, but unlikely all 3.

As far as I know, Facebook uses the services of AppDetex (https://www.appdetex.com/) to go after domains they consider to be similar to their brands, sometimes even in quite a broad partial match type of sense. The emails they send are strongly worded and request a handover of the domain within a short time. I guess they do this to save legal fees.
