Below is a summary of CDRP decisions, starting from the very first decision on October 7th 2002 up until May 1, 2010.

I thought it was interesting data so I thought I'd share. It would also be interesting to see how the stats below would compare with all the decisions since then. Perhaps a project for the future when I have time.

Summary of CDRP Decisions

Executive Summary

Enclosed is a chart which provides a summary of decisions of the CIRA Domain Name Dispute Resolution Policy (CDRP) from the beginning of the CDRP in 2002 until May 1, 2010. The summary was created following a review of all the CDRP decisions on the CIRA website. The chart provides the following information:

  • The name of the Complainant and Registrant, and the domain name at issue in each of the decisions
  • The dispute number of each of the decisions, along with a link to the decision on the CIRA website
  • The particular Service Provider (Resolution Canada or the British Columbia International Commercial Arbitration Centre) which handled the dispute
  • Whether a response was filed by the Registrant in each of the cases
  • The number of panellists which presided over each case
  • The outcome of the decision (e.g. whether the domain name was transferred to the Complainant, or whether the complaint was dismissed)
  • The date of the decision.

As of May 1, 2010, there have been 149 decisions. A breakdown of the number of decisions by year, as compared with the approximate total number of dot-ca domain name registrations that year, is set out as follows:

One decision out of the 149 decisions dealt with a costs order against the Complainant; the only such order against a Complainant. Of the remaining 148 decisions:

The domain name was transferred in 116 decisions (approximately 78%). The complaint was dismissed in 32 decisions (approximately 22%).
A three member panel was involved in 67 decisions (approximately 45%). A one member panel was involved in 81 decisions (approximately 55%).
The Registrant failed to file a response in 92 of the cases (approximately 62%). In the 92 cases where a Registrant failed to file a response, the Complaint elected to proceed with a one member panel in 81 of the cases (approximately 88%). The Complaint elected to maintain the three member panel in 11 of the cases (approximately 12%).
93 decisions (approximately 63%) were handled by BCICAC. 55 decisions (approximately 37%) were handled by Resolution Canada.
