Mira Holdings asks court for help after losing cybersquatting case.

Mira Holdings filed its lawsuit in U.S. District Court in Arizona. It’s asking the court for a declaratory judgment that its domain registration is not cybersquatting, and for damages for reverse domain name hijacking.

Exactly what I would have done if my case would have been lost.

John Berryhill had already talked with Zack to handle the case had a loss occurred.

We would have made the complainant come to Canada to argue their case and even if the court would have ruled against me we would have appealed. There was really no way the complainant was going to get the domain name without going all the way through the court system.

I'm actually quite fearless and have gone to court many times for my previous businesses so the process is familiar to me and knowing the end value of the domain it is highly unlikely I would not have pursued my defense well past the UDRP.

Again my case was different because it was a generic pronounceable so the case of TEMCO.com above is more tricky and one has to weigh how many legitimate end users there are for the domain and what they are likely to pay to own it. If court fees are going to outpace end value then having pride cloud your judgement is the wrong decision.
