Country flag
I'm pretty careful when it comes to registering domains and never go after TMs, but I guess not careful enough, as I just got hit with a pile of CIRA emails.

Interestingly, this same law firm on the CDRP made an offer to buy the domain through Dan, which I countered and they disappeared, so it was obviously a trap bid that I plan on including with my response.

Needless to say I am not pleased, especially as they have not made any official contact to try and mediate the situation, as required by the CDRP.

That's annoying. Sounds like a hail mary.

DomainRecap @DomainRecap In your opinion, is it the law company trying to secure it for themselves or a client?

I have yet to have the pleasure of CDRP, but I did get a broker offer today for a 4l.ca, which could easily be coming from a law company. However, not worried about it.

I mostly do google searches when buying domains but rarely dig deep into trademark searches. In other's opinions, what can be a sweet spot when pricing a problematic domain for a quick sale and CDRP avoidance?

Sounds like you took the proper precautions prior to registration. Wishing you the best.

There are so many TM domains for sale all over the place...surely you'll be fine, unless you're hosting something on there that's conflicting with the TM holders business, no?

I mean, look at this...

lol, I'm guessing the domain will have a new owner, and you'll have a bigger bank account...

I'm guessing it was a soso domain and he just let them have it uncontested.
I've done that and there is no shame in it. I simply weighed what I thought I would get for the domain and what my time, effort and legal would be.

Like Kenny Rogers used to say....

You got to know when to hold 'em,
Know when to fold 'em,
Know when to walk away,
And know when to run.
You never count your money
When you're sittin' at the table.
There'll be time enough for countin'
When the dealing's done.

Every gambler knows
That the secret to survivin'
Is knowin' what to throw away
And knowin' what to keep.
'Cause every hand's a winner,
And every hand's a loser,
And the best that you can hope for
Is to die in your sleep."

Bad deal. If I can help please let me know. The offer to purchase on Dan is a great piece of evidence. Was there ever any prior contact trademark claim or CND issued by the TM holder poor to their offer on dan

Every word is trademarked! It is not the registration of the domain name that causes damage it is the use and so you can own trademark names as long as the use is not interfering with a trademark

In retrospect I should add that registering domain names with famous trademarks like MICROSOFT is not a good idea! Registering bing.com would be fine but it would be tough to explain to a judge exactly what was going on in your mind at the time you (i mean anyone not your) registered microsoftbing.com! What possible non infringing use could that have LOL
