Ferrari Wins Legal Battle Over Iconic 'Testarossa' Name​

Ferrari won an important legal battle this week, when the European Union’s General Court agreed to return the rights to the “Testarossa” trademark to the automaker. Ferrari had been stripped of its rights to use the name when a German toy company argued that the Testarossa name had not been use for more than five consecutive years, and thus Ferrari no longer had claim to it.
 
But a few years back, German toy company Autec AG wanted to use "Testarossa" for a series of their own products — and they didn’t want to pay a licensing fee to Ferrari. So, Autec went to court and argued that, since Ferrari had not used the name in many years, Maranello no longer had the rights to it. After all, the last Ferrari bearing the Testarossa name was built in 1991, and while the 512 TR and F512 M were part of the same family, but even the the newest has been out of production since 1996. The courts agreed with the toy maker, and in 2017 Ferrari lost the rights to the famous moniker.

Luxury sports car brand Ferrari was recently caught in a logo debacle with an unexpected opponent – Malaysian energy drink brand, Wee Power. Amusing name aside, the drinks brand's packaging featured a rearing horse that Ferrai claimed infringed on its iconic equine logo – the High Court thought otherwise.

It's undeniable that Ferrari's emblem is one of the best car logos of all time, but horse imagery appears in many rival brand identities, from Porsche to Mustang. While Wee Power's packaging may share a similar equine theme, it's clear that Ferrari's claim lacked the horsepower to win the dispute.
