When I add it up it only comes to $180 not $268…am I not reading it right?

Policy is not law, so I would simply remove the SURCHARGE and tip what I normally would.
Personally I tip 15% but before taxes and I don't tip on $50 bottles of wine.

Way back in Niagara falls the restaurants charge a tourist tax, I immediately remove it from the bill. It is something the restaurants charge and actually not a real tax, in fact I would argue that calling it a tax is borderline illegal.

First, that bill is likely completely bogus. But if I was actually presented with that bill, I would have paid zero, tipped zero, and called the cops to come press charges, then wrote a letter to the editor, posted the bill on every social media, and called out the blatantly crooked owner.

Not typically, no. But its possible there was some amazing service.
To be honest, I despise the tip culture we've been conned into. A tip should be optional, for exceptional service. You shouldn't get any tip for just doing your job. Too many shitty servers expect their tip and are only there at your table and suddenly friendly when presenting the bill. And they start asking you questions while being presented with the credit card machine to distract you on purpose. We're all being scammed if you ask me.

This is still happening. I went earlier this year and was charged a 10% 'Destination Fee' at a restaurant. The waiter claimed it was mandatory and they couldn't remove it. Hopefully some of that goes to them, because no one at our table left a tip.
I challenged it and the restaurant was caught lying, I made the news that time and it was even more devious because they called it a Tourist Tax but the restaurant kept it. I told them it is illegal to call something a tax that is not.
And as far as not removing it goes, just get up and walk out, tell them they have the option to remove or you walk.
Additional service charges are not mandated to be paid by law.

Just be careful, if the menu clearly states the extra fees, then they can say you were warned and you chose to stay, therefore you pay.
Again policy is not law and even a small footnote on the menu is not good enough, technically it has to be clearly displayed where you can see it before you order.
In my case it was a tiny line on the bottom of the menu and was not mentioned on the receipt at all, was basically called a tourist tax.

I agree, and calling it a tax is fraudulent in my opinion too. But it is a buyer-beware world out there.
